Il Giudice Sportivo del Comitato Regionale Puglia della Lega Nazionale Dilettanti, Avv. Angelo Maria Romano, assistito dal rappresentante dell’A.I.A., Sig. Pasquale Cariello (delegato del CRA Puglia), nella seduta del 09/03/2010 , ha adottato le decisioni che di seguito integralmente si riportano:

Il Giudice Sportivo;
- letti gli atti ufficiali;
PREMESSO
- che al 23' del primo tempo il Signor Gatto Daniele (Director of the company MESH) together with three foreign players surround the referee at his address uttering insulting remarks and threats;
- at the end of 1st half the race director was joined by some spit and pebbles thrown by fans the sweaters they did not bring consequences
- that in the tunnel outside the locker room ten subjects with the aforementioned cat ignores Daniel uttered threatening words again at the referee, behavior that was repeated when the erna retraced the tunnel to return to field and starting the second time;
- that at the end of the first half of assistant was hit by a spit in the face Jerseys from the fans;
- that at the end of the race card holders Velazko Kevin (MESH) and Cezza Pierpaolo (MESH) uttered insulting remarks at the referee and threatening;
- and inside the tunnel leading to the locker room about twenty persons outside spit and hit the referee with small pebbles, uttering insulting remarks and threats;
- this last demeanor was kept by Mr. Joseph Toma (executive escort Jersey) and Mr. Karel Zeman (coach sweaters);
- one assistant was surrounded by gentlemen pump Luigi (Jerseys) Sabatelli Alessandro (Jerseys) Cezza Pierpaolo (sweaters) and Kevin Velazko (sweaters) that the pushing and tugging violently, uttering insulting remarks to his address and threatening;
- that in the tunnel leading to the locker room the same assistant was joined by a spit, stones and lighters that struck him in the back without causing particular pain;
- that in such predicaments Joseph Toma (Jerseys) uttered insulting remarks to his address;
- that on the way from the locker rooms to the parking car were about forty persons outside and two of them tugging the referee and hit him with stones and spitting;
- that in this juncture Director race was hit by two kicks to the calf, from a lighter on the shoulder and a bucket of water despite the presence of the police;
- that in this context managers and players in the jerseys unidentified assistant referee hit repeatedly with spitting in the face and kicked on his legs causing him severe pain;
- that in the tunnel leading to the parking subject matter hit the same server with spitting, kicking legs and various objects;
- the second assistant was hit in face with spittle coming from supporters of sweaters and small stones on the legs without consequences;
- once entered into the machine with the same referee was surrounded by about ten fans that hit with stones, fists, kicks and spits on the side and tried in vain to open the door;
- that the vehicle was escorted by police to the neighboring town of Sternatia;

- to impose the company USD TOMA SWEATER the sanction of sports dispute numbers FIVE GAMES IN CAMERA FIELD IN NEUTRAL WITH IMMEDIATE EFFECT ;
- to impose the company USD TOMA SWEATER the fine € 1000.00 .

- to disqualify the licensed PUMP LUIGI (sweaters) and Sabatelli ALESSANDRO (sweaters) for SIX days ;
- to disqualify the licensed Cezza PIERPAOLO (sweaters) and VELAZKO KEVIN (sweaters) for EIGHT days .

A fine gara soggetti estranei si avvicinavano ad un assistente dell'arbitro ed uno di essi pronunciava al suo indirizzo espressioni ingiuriose e minacciose.
Inoltre veniva lanciato in campo una bottiglietta di plastica che si fermava nei pressi del secondo assistente ( SOCIETÀ GIÀ SOGGETTA AD ANALOGA SANZIONE E RECIDIVA PER CINQUE VOLTE - SANZIONE DA SCONTARSI IN CAMPO NEUTRO CON EFFETTO IMMEDIATO ).

At the end of the first half an unrelated uttered insulting remarks at an assistant referee and hit him with a violent kick on the left knee is not without consequences. At the end of the race
another person unconnected hit the same server with a violent slap on the back of his head causing him severe pain and, despite the presence of a policeman chasing the employee for more than twenty meters trying to hit him repeatedly with no success. Deliberations of Disciplinary Committee Territorial Place the Disciplinary Committee, chaired by Adv. Angelo THE OLD MUST involving Att. Giancarlo De Peppe and goodwill. Joachim GHIRO (components), at its meeting on 25 January 2010 adopted the following measures:
IN CASE sponsored by the Federal Prosecutor FIGC by application of 25/11/2009 (protocol n.2939/256pf / 09../AA/ac) against:

MAURIZIO STRIPED footballer currently registered with the ASD Atletico Tricase;

MAURIZIO Fanuli , President of ASD Cupertino;
3)
CLAUDIO DE PASCALE , manager of the company 'ASD Cupertino;
4) the company

NEW NARDO' SOCCER TO MEET - Mr.
MAURIZIO STRIPED the violation of Article 1, section 1 CGS, with reference to Article .40, paragraph 4, of NOIF and article 10, paragraphs 2 and 4 of the CGS to have signed a request of membership for the Cupertino company ASD, while he was affiliated to another company, as described in the grounds and the violation of which all''art 1, paragraph 1, of the Code of Sports Justice, in conjunction with Article .10, paragraphs 2 and 6 of the CGS, for violation of the principles of loyalty, honesty and probity, he played for Virtus Casarano races - of Cupertino and Cupertino 01/25/2009 - New Nardò 1 / 2 / 2009 of the League of Excellence CR Puglia in the ranks of society without authority because ASD Cupertino un'azltra registered with the company, as described in the grounds;
- Mr.
MAURIZIO Fanuli the violation of Article 1, section 1, CGS, with reference to Article .40, paragraph 4, of NOIF and article 10, paragraphs 2 and 4, the CGS, for signed the application for membership of the player Maurizio Striano, without having carried out with due diligence due diligence investigations aimed at identifying the possible existence of barriers against the membership contract in question;
- Mr.
CLAUDIO DE PASCAL della violazione di cui all'art.1, comma 1, del Codice di Giustizia Sportiva, anche in relazione all'art.10, commi 2 e 6, del CGS, per violazione dei principi di lealtà, correttezza e probità, per aver sottoscritto le distinte delle gare Virtus Casarano – Copertino del 25/1/2009 e Copertino – Nuova Nardò dell'1/2/2009 del Campionato di Eccellenza C.R.Puglia in cui dichiarava che i giocatori ivi menzionati erano regolarmente tesserati e partecipavano alla partita sotto la responsabilità della società di appartenenza, malgrado il calciatore Maurizio Striano non ne avesse titolo come succintamente descritto nella parte motiva;
- la società
ASD COPERTINO a titolo di responsabilità diretta e oggettiva, ai sensi dell'art.4, commi 1 e 2, del CGS per le violazlioni ascritte al Presidente nonché dei propri tesserati ovvero dei soggetti che comunque abbiano svolto attività nel suo interesse ai sensi dell'art.1, comma 5, CGS;
- la società
NUOVA NARDO' CALCIO , a titolo di responsabilità oggettiva, ai sensi dell'art.4, comma 2, del CGS, nelle violazioni ascritte al proprio tesserato;
FATTO Con nota del 3/8/2009 il Responsabile della Commissione Tesseramenti FIGC trametteva alla Procura Federale – per le indagini di sua competenza -, gli atti relativi al reclamo proposto dal calciatore
Maurizio Striano avverso il mancato tesseramento in favore della società
ASD Copertino da parte del Comitato Regionale Puglia.
*************** Dall'esame della documentazione acquisita nel corso degli accertamenti espletati, la Procura Federale rilevava: -
che il calciatore Maurizio Striano in data 22/9/2007 veniva tesserato per la società USD A.Toma;
- che in data 19/9/2008 , lo stesso veniva trasferito “ in prestito “ alla società Nuova Nardò Calcio;
- che successivamente, that last company inserted the player on the list of "supplementary release" of 15/12/2008;
- that on 20/12/2008 , the ASD Cupertino, sent the request for membership n.205436, Maurizio Striano on the player, and that that request was not accepted by the Regional Committee in Puglia since the player was on loan to the company Nardò New Soccer and could not therefore be included in the list of "release" from that company;
- that on 24/02/2009 Mr . Maurizio Striano lodged a complaint to the Commission against the non-membership Membership;
- Membership that the Commission, by a decision published on the CU No. 17 / D dismissed the complaint by confirming the validity of the membership with "temporary entry" to the company Nardò New Football;
- that this ruling became DefInt why do not appeal;
- that based on what first attracted , footballer Maurizio Striano and ASD Cupertino in the person of its President and the statutory agent. Maurizio Fanulli in the same season, had signed a second request for membership, while the same player had already registered with another company;
- che il sig. Maurizio Fanuli , nella sua riferita qualità, non aveva posto in essere con la dovuta diligenza e cautela, le opportune verifiche volte a determinare lo “status” del calciatore e la sussistenza di eventuali impedimenti di natura contrattuale per un eventuale valido tesseramento;
- ritenuto pertanto che i fatti , come innanzi succintamente descritti integravano gli estremi della violazione di cui all'art.1, comma 1, CGS, con riferimento all'art.40, comma 4, delle NOIF e all'art.10, commi 2 e 4, del CGS, ascrivibili al sig. Maurizio Striano, (calciatore tesserato per la società ASD Atletico Tricase), nonché Mr. Maurizio Fanuli, as Chairman and legal representative of the ASD Cupertino;
- that also examination of the documents received by the Federal prosecutor, Maurizio Striano the player had been employed by the company in Cupertino ASD Virtus Casarano races - Cupertino of 01.25.2009 and Cupertino - New Nardò 1 / 2 / 2009 Championship of Excellence in Puglia CR illegally because the companies affiliated with New Football Nardo and that the name of the player Maurizio Striano had been placed in separate players the above events, sign, - as manager official escort -, by. Claudio De Pascale, director of ASD Cupertino;
- therefore, with the subscription lists of the aforementioned Mr race. Claudio De Pascale was then confirmed certificate and (incorrectly) the regularity of the enrolled participants in the races above, under the responsibility of society to which they belong, according to current regulations;
- that Mr. Maurizio Striano had participated in the said competition in the interest of soc. ASD Cupertino;
- that occurred participating in tenders for a player of another company incorporated for the violation of the principles of fairness enshrined in Article probity and rectitude sports. 1, paragraph 1 of the CGS report also article 10, paragraphs 2 and 6 of the CGS, due to Mr. Maurizio Striano, player of the ASD Atletico Tricase and Mr. Claudio De Pascale, director of the Cupertino company ASD;
- that the Judge of the Regional Committee of Puglia with the published decision on the CU No. 52 of 02.26.2009, for violations relating to illegal participation of the player races , above mentioned, had decided for the punishment of the loss of sporting events covered by the ASD Cupertino why the same could not be re-judged, punished and fined for the same offense;
- now therefore la Procura Federale della FIGC con la nota succitata del 25/11/2009 deferiva a questa Commissione i succitati sig.ri Striano Maurizio, Fanulli Maurizio, De Pascali Claudio (nelle rispettive loro qualità innanzi menzionate) e le società ASD Copertino e Nuova Nardò Calcio, affinchè rispondessero delle violazioni innanzi contestate e testualmente trascritte.

Verificata la regolarità delle contestazioni e delle comunicazioni di rito, con racc.a.r. del 22/12/2009, la Commissione Disciplinare Territoriale Puglia, disponeva la convocazione delle su menzionate parti deferite per l'udienza del 13/10/2008 alla quale comparivano:

- Mr. assisted by Dr Maurizio Striano. Giampaolo Calò replacing Att. Edward Chiacchio ;
- the New Football Nardo represented. Sandro Matino ;

at the joint request of the S. Federal Attorney lawyer. Giuseppe Monaco, Striano the player and his lawyer Dr Maurice. G. Calo, and Att. S. Matino for New Soccer Nardo, the Discipline Committee referred the Territorial appearance of the parties who appeared at the hearing on 15/2/2010:
- for represented by the Federal Prosecutor's Office. Giuseppe Monaco ;
- for the soc. New Football Nardò represented. Sandro Matino ;
- Mr. Maurizio Fanuli on his own and as Chairman of the soc. ASD Cupertino;
- Mr. assisted by Maurizio Striano. Gianpaolo Calò replacing Att. Edward chat.

At the outset, the lawyer. P. Monaco for the Federal prosecutor and lawyer. Matino for soc. New Football Nardo, said they had achieved - under article 23 n.1 CGS, the agreement on the extent of the penalty to be taken, as follows: "Fine of € 250.00 per load soc. New Nardò Football ....".
this request on which the Disciplinary Commission - pursuant to article 23 No.2 CGS - stated that the power to review and to lift the reservation with the final measure.

expressly rejected the so-called "plea bargaining" (art. 23 n.1 CGS) and asked to proceed further nell'istruttoria hearing, both the player Maurizio Striano that Mr. Maurizio Fanuli in quality acts.

Procedutosi interrogation of Messrs. Maurice and Striano Maurizio Fanuli (for himself and as President of ASD Cupertino), after giving act of removal Att. S. Matino defender and representative of the soc. New Nardo 'Soccer, and declared closed the preliminary hearing stage - for lack of further requests, the parties present were invited to screen their conclusions, which - after much debate - were formulated as follows:
- represented. G. Monaco for the Federal Prosecutor:
"..... me back in full to the pleadings and in particular to the application made by Striano before the Commission Membership and express the following requests for condemnation of: - the player Maurizio Striano disqualified for 2 years; - Mr. Maurizio Fanulli the inhibition of 3 months; - Mr. Claudio De Pascali inhibition of 2 years - for the Cupertino company ASD fine of € 1,000.00;
- represented. Gianpaolo falling for the footballer Maurizio Striano
asked ".... primarily the acquittal of the player and Maurizio Striano in the alternative impose the minimum penalty provided by the Code of Sports Justice ....";
- Mr. Maurizio Fanulli for themselves and for society as represented by him asked: "...... the total full assoluzione da ogni addebito mosso dalla Procura Federale, per aver sempre agito in buona e perfetta fede sulla base dei documenti acquisiti agli atti del processo, sempre ritenuta valida e mai posta in dubbio sotto il profilo formale e sostanziale.....”.
La Commissione si riservava di decidere.

MOTIVI DELLA DECISIONE
1) “ Thema decidendum ” del presente giudizio (sulla base delle contestazioni mosse dalla Procura Federale innanzi testualmente riportate) è la sola valutazione degli effetti prodotti dall'invalidità del tesseramento, posto in essere – in concorso fra loro – by Soc. New Nardò Football, soccer player from Mauritius Striano and M. Maurizio Fanuli (as President of ASD in Cupertino), and then if - and to what extent - there are responsibilities charged to the SoC. ASD Cupertino and New Nardò: in addition to alleged personal liability of Mr. Claudio De Pascali (ASD Cupertino manager) for having confirmed with the signing of the separate notice, the regular membership of the player Maurizio Striano.

The referral de quo, takes it origin from the transmission of documents to the Prosecutor Federale, da parte della Commissione Tesseramenti della FIGC, a seguito e per effetto della decisione (pubblicata sul C.U. n.17/D) di rigetto del reclamo proposto dal calciatore Maurizio Striano e della conferma della validità del tesseramento con vincolo temporaneo in favore della soc. Nuova Nardò Calcio, ostativo quindi di ulteriori tesseramenti nella stessa stagione sportiva con altre società.

Decisione questa divenuta definitiva e vincolante (quale “ res judicata ”) perchè non impugnata dalle parti interessate e che pertanto non consente di revocare in alcun modo in dubbio la responsabilità del calciatore Striano e del sig. Fanuli (nella As president of ASD Cupertino) for violations of Article 1, section CGS with reference to Article .40 - NOIF paragraph 4 of article 10 and paragraphs 2 and 4 of the CGS, as punishable by the device, together with ASD cover (for direct and objective responsibility under Article 4 paragraph 1 and 2 of the CGS) and New Nardò Football (for strict liability under Article 4 paragraph 2 of the CGS).

should therefore be rejected requests for acquittal made by the player Striano Mauritius and President of ASD Cupertino Mr. Maurizio Fanuli during these proceedings.

2) For what it concerns the extent of sanctions, should be welcomed - even if only partially - the view of some of the referrals for the following reasons .

note of the agreement should be first given the lag between the soc. New Nardò Football and the Federal Prosecutor's Office, for which the Commission, read and applied Article .23 n.2 CGS, says the fair penalty fine of € 250.00 agreed between the parties before mentioned, and shall have the 'as applied to the device.

As it concerns the player Striano Mauritius and the Chairman Mr. Maurizio Fanuli , it should be said immediately that the information gained in the process to suggest that the above referrals, they have been misled by a company when it was their New Football Nardò that the previous membership (USD Toma from the New Jersey Football Nardò ) was a "firm" and not "temporary" and was therefore valid and legitimate subsequent transfer ASD Cupertino.

good faith and be misled, however, that does not exempt the objections raised against them by referrals , (di scarsa diligenza e di omesse verifiche relative all'invalidità del tesseramento) e che pertanto non assurgono, a dignità di “esimenti” ma solo di “attenuanti”, in verità supportate da altri aspetti (rimasti non del tutto chiariti processualmente), a cominciare dalla diversità delle date di comunicazione, da parte degli organi amministrativi competenti, relative al mancato accoglimento della richiesta di tesseramento del 20/12/08 del calciatore Striano.
Dagli atti del processo risulta infatti che la comunicazione della invalidità del tesseramento del calciatore Striano è stata effettuata alla Nuova Nardò Calcio con telegramma datato 29/1/2009; mentre per l'ASD Copertino l'analoga comunicazione risulta effettuata con telegramma datato 3/2/2009.
Diversità di date che hanno inciso fortemente quanto meno sull'esito della gara Copertino – Nuova Nardò Calcio dell'1/2/2009 che, peraltro risulta vinta dalla Nuova Nardò su suo reclamo utilizzando quella stessa invalidità (alla cui realizzazione aveva concorso insieme ad altri) della quale era appena venuta a conoscenza con la suddetta comunicazione del 29/1/09.
Tant'è che il Giudice sportivo dell'epoca, fu indotto ad accogliere il reclamo ma a rimettere gli atti alla Procura Federale per gli accertamenti ed i provvedimenti di sua competenza (v.delibera pubblicata sul C.Uff. n.52 pag.12/13 del C.R.P.).

Le sanzioni comminate al sig. Striano, all'ASD Copertino ed al sig. Maurizio Fanuli (nella ridetta qualità) indicate in dispositivo, non potevano quindi non tenere conto di quanto innanzi evidenziato e sono state pertanto determinate applicando le ricorrenti, quanto doverose attenuanti.

3) Va di contro mandato assolto da ogni addebito il dirigente dell'ASD Copertino, sig. Claudio De Pascali , per i motivi che seguono.

La contestazione della Procura Federale mossa al su menzionato sig. Claudio De Pascali is that of "... violation of Article 1, section 1 of the Code of sports justice, even in relation to article 10 paragraphs 2 and 6 of the CGS for violation of the principles of loyalty, honesty and probity , for having signed the separate races "Virtus Casarano - 25/1/2009 Cover" and "Cover - New Nardò 1 / 2 / 2009" Championship of Excellence CR Puglia stating that players were regularly referred to therein enrolled and attending the game under the responsibility of society to which they belong, right rules, despite the player had not Striano Maurizio title .... "(text).

E' del tutto evidente quindi che una tale contestazione si fondi sul presupposto della “nullità” del trasferimento del calciatore, Striano dalla Nuova Nardò Calcio alla ASD Copertino così come statuito dalla Commissione Tesseramenti (di cui al C.U. n.17/D) con provvedimento del seguente tenore: “.....per quanto sopra non si potrà che confermare valido il trasferimento a titolo temporaneo della USD A.Toma Maglie a favore della srl Nuova Nardò Calcio del calciatore Striano e per l'effetto nullo quello a favore dell'ASD Copertino....” (testualmente).
